Terms of Service

These Terms of Service ("Terms") are a legally binding agreement between you and GetBotl ("we," "our," or "us"). By using our app, website, or services, you confirm that you:

• ✓Are at least 21 years of age
• ✓Have read and agreed to these Terms
• ✓Have the legal ability to enter into this agreement

If you do not agree, please do not use our services. We may update these Terms from time to time — continued use after updates means you accept the changes.

GetBotl is a technology platform that connects adult consumers with licensed liquor stores in New York for on-demand alcohol delivery. GetBotl does not sell alcohol directly — all sales are made by licensed retail store partners.

To use GetBotl, you must:

• ✓Be 21 years of age or older — no exceptions
• ✓Complete our identity verification before placing your first order
• ✓Have a valid government-issued photo ID
• ✓Have only one account — multiple accounts are not allowed
• ✓Be located in an area where GetBotl operates at the time of your order

Age verification is required by law and is mandatory for all users.

Purchasing alcohol for anyone under 21 is strictly prohibited and will result in immediate account termination.

• ✓Someone must be home: An adult (21+) must be present to receive the order. Couriers cannot leave alcohol unattended.
• ✓ID at the door: You must show a valid photo ID to the courier on every delivery.
• ✓Failed delivery: If no eligible adult is present, the order will be returned. The applicable delivery fee will be kept and the rest refunded.
• ✓Cancellations before acceptance: Full refund within 3–5 business days.
• ✓Cancellations after acceptance: A cancellation fee applies. The remainder will be refunded within 3–5 business days.

• ✓Product prices: Set by the store. GetBotl does not add any markup to product prices.
• ✓Delivery fee: A delivery fee applies to all orders. The current fee is displayed at checkout.
• ✓Taxes: All applicable New York taxes are calculated at checkout.

The following are strictly prohibited:

• ✗Buying alcohol for or on behalf of anyone under 21
• ✗Creating multiple accounts
• ✗Submitting false, expired, or someone else's ID
• ✗Using fraudulent payment methods
• ✗Reselling alcohol purchased through GetBotl without a license
• ✗Harassing or threatening couriers or store staff
• ✗Using bots or automated tools to access the platform

Violations may result in account suspension, order cancellation, and referral to law enforcement.

Stores that join GetBotl as retail partners agree to the following in addition to the Merchant Agreement:

• ✓You must hold a valid New York State Liquor Authority (NYSLA) license at all times
• ✓You must notify us immediately if your license status changes
• ✓GetBotl may suspend your access if your license is expired, suspended, or under investigation
• ✓The legal sale of alcohol is between you (the store) and the customer — GetBotl facilitates but does not make the sale

• Order disputes: Our maximum liability for any order-related claim is the total amount you paid for that order.
• Third-party actions: We are not liable for the actions of store partners or couriers beyond our role as a platform.
• Service availability: We do not guarantee uninterrupted service and are not liable for losses from outages or technical issues.

Indemnification: You agree to hold GetBotl harmless from any claims or damages arising from your violation of these Terms or misuse of our services.

These Terms are governed by the laws of the State of New York. Any disputes should first be raised with us directly at info@getbotl.com so we can try to resolve them. If a resolution cannot be reached, disputes will be handled through binding arbitration or in the courts of New York County, New York.
