Terms of Service

Please read these terms carefully before using the GetBotl platform. By creating an account or placing an order, you agree to be bound by these terms.

Section 1

Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and GetBotl Inc. ("GetBotl," "we," "our," or "us") governing your access to and use of the GetBotl mobile application, website, and related services (collectively, the "Services").

By accessing or using the Services, creating an account, or placing an order, you represent that you:

  • Are at least 21 years of age
  • Have read and understood these Terms in their entirety
  • Agree to be bound by these Terms and our Privacy Policy
  • Have the legal capacity to enter into a binding agreement

If you do not agree to these Terms, you must not use the Services. We reserve the right to update these Terms at any time, and your continued use of the Services following notice of changes constitutes acceptance of the revised Terms.

Section 2

Description of Services

GetBotl is a technology marketplace platform that connects verified adult consumers with licensed alcohol retail stores in New York State. GetBotl facilitates transactions between consumers and licensed retailers — GetBotl itself is not a licensed alcohol retailer and does not sell alcohol.

Important: All alcohol sales on the GetBotl platform originate from and are completed by licensed retail partner stores holding valid NYSLA off-premises licenses. GetBotl provides the technology platform, payment processing, identity verification, and logistics coordination services, but the legal sale of alcohol is made by the retail partner at the moment of checkout.

GetBotl's Services include:

  • A digital marketplace for browsing and purchasing alcohol products from licensed local retailers
  • Age and identity verification services to ensure compliance with NY ABC Law
  • Order routing and coordination with licensed retail partners
  • Delivery coordination through our trained courier network
  • Payment processing via Stripe
  • Customer support and dispute resolution

Section 3

Eligibility

To use the GetBotl Services, you must meet all of the following eligibility requirements:

  • Age: You must be 21 years of age or older. There are no exceptions to this requirement.
  • Verified Identity: You must successfully complete GetBotl's identity verification process before placing your first order.
  • Valid Government-Issued ID: You must hold a valid, unexpired government-issued identification document accepted by GetBotl's verification process.
  • One Account Per Person: You may maintain only one GetBotl account. Creating multiple accounts to circumvent verification, suspensions, or other platform restrictions is a material violation of these Terms.
  • Legal Jurisdiction: You must be located in a jurisdiction where alcohol delivery is legal and where GetBotl operates at the time of your order.
  • Delivery Address: Your delivery address must be a residential or commercial address within our active delivery area.

GetBotl reserves the right to verify eligibility at any time and to suspend or terminate accounts that fail to meet eligibility requirements.

Section 4

Age Verification

Age verification is mandatory under New York ABC Law and is a non-negotiable requirement for using GetBotl. We operate a two-layer age verification system: digital pre-verification and in-person door verification on every delivery.

Digital Pre-Verification (One-time)

Before placing your first order, you must complete a one-time digital identity verification. This requires submitting a photo of a valid government-issued ID and a real-time selfie for liveness detection. Verification confirms your identity, the authenticity of your document, and that you are 21 or older.

In-Person Door Verification (Every Delivery)

Regardless of your pre-verified status, you must present a valid government-issued photo ID to the courier at the time of every delivery. The courier is required by law to check your ID, confirm your name matches the account, and verify that your date of birth indicates you are 21 or older on the date of delivery.

Providing false, altered, or fraudulent identification in connection with age verification is a violation of these Terms and may constitute a criminal offense under New York Penal Law. GetBotl will terminate your account and may report violations to applicable law enforcement authorities.

Ordering alcohol for a person under 21 years of age ("straw purchasing") is strictly prohibited, constitutes a violation of NY ABC Law Section 65, and will result in immediate account termination and referral to authorities.

Section 5

Orders and Delivery

Orders placed through GetBotl are fulfilled by licensed retail partner stores and delivered by our courier network. The following terms govern the order and delivery process.

  • Fulfillment by Retail Partners: Your order is legally sold by the retail partner that accepts it. GetBotl routes your order to an appropriate licensed store based on your delivery address, store availability, and inventory.
  • Present at Delivery: You or an authorized adult (21+) must be present at the delivery address to receive the order. Couriers are legally prohibited from leaving alcohol unattended at a doorstep or with an unchecked recipient.
  • ID Required at Door: A valid government-issued photo ID must be presented to the courier at delivery, even if you have completed digital pre-verification. Failure to present valid ID will result in the courier refusing the delivery.
  • Cannot Leave Unattended: Couriers are strictly prohibited by NY ABC Law from leaving alcohol unattended. If no eligible adult is present to receive the delivery, the order will be returned to the store.
  • Cancellations Before Acceptance: Orders cancelled before a retail partner has accepted the order will receive a full refund to the original payment method within 3–5 business days.
  • Cancellations After Acceptance: Orders cancelled after a retail partner has accepted the order are subject to a $3.99 cancellation fee. The remaining order total will be refunded within 3–5 business days.
  • Failed Deliveries: If a delivery cannot be completed due to no eligible adult being present, the courier refusing to deliver (ID failure, signs of intoxication, etc.), or other delivery-side issues, the order will be returned to the store. A $3.99 delivery fee will be retained. The balance will be refunded within 3–5 business days.

Section 6

Pricing and Fees

GetBotl is committed to transparent pricing. Here is how pricing works on our platform:

  • Product Prices: Product prices are set by the licensed retail partner and reflect the store's retail prices. Prices may vary between stores.
  • Delivery Fee: A flat $3.99 delivery fee applies to all orders, regardless of order size or distance within the delivery zone.
  • No GetBotl Product Markup: GetBotl does not add a markup to the retail price of any product. The price you see is the price the store charges.
  • Applicable Taxes: All applicable New York State and local sales taxes are calculated and collected at checkout.
  • Price Variability: Prices may differ between retail partners for the same product. GetBotl displays prices as provided by stores and is not responsible for pricing errors by retail partners.
  • Promotions: Promotional pricing and discounts are subject to their own terms and may be modified or discontinued at any time.

GetBotl reserves the right to modify the delivery fee with reasonable advance notice. The fee in effect at the time you place your order is the fee that applies to that order.

Section 7

Prohibited Uses

The following activities are strictly prohibited on the GetBotl platform and constitute material violations of these Terms:

  • Purchasing alcohol for, or with the intent to provide to, any person under 21 years of age ("straw purchasing")
  • Creating multiple accounts to circumvent identity verification, account suspensions, or platform restrictions
  • Submitting fraudulent, altered, expired, or another person's identification documents
  • Attempting to circumvent or undermine the age verification process in any manner
  • Using the platform to purchase alcohol for commercial resale without proper licensing
  • Placing orders outside of legally permitted alcohol sales hours in your jurisdiction
  • Using fraudulent payment methods, stolen credit cards, or chargebacks fraudulently
  • Harassing, threatening, or interfering with couriers or retail partner employees
  • Using automated tools, bots, or scripts to access the platform
  • Attempting to reverse-engineer, scrape, or exploit the GetBotl platform in any unauthorized manner

Violations of these prohibitions may result in immediate account suspension or termination, forfeiture of pending orders, reporting to applicable law enforcement authorities, and/or legal action by GetBotl.

Section 8

Merchant Terms

Retail stores that list their inventory and fulfill orders through GetBotl ("Merchant Partners") are subject to the terms set forth in the separate GetBotl Merchant Agreement, which governs the business relationship between GetBotl and retail partners. The following provisions also apply:

  • License Requirement: All Merchant Partners must hold and maintain a valid NYSLA off-premises license (Liquor, Beer, Wine, or applicable combination license) for the duration of their participation on the platform.
  • License Verification: GetBotl verifies Merchant Partner licenses against the New York State Liquor Authority public license database during onboarding and monitors license status on an ongoing basis.
  • License Issues: GetBotl may immediately suspend a Merchant Partner's access to the platform without liability if the partner's license is expired, suspended, revoked, or under formal NYSLA investigation.
  • Notification Obligation: Merchant Partners are required to immediately notify GetBotl of any NYSLA investigation, enforcement action, license suspension, or ownership change that may affect their license status.
  • Legal Title: The legal sale of alcohol occurs at the point of checkout between the consumer and the Merchant Partner. GetBotl does not take legal title to alcohol products at any point in the transaction.

Section 9

Limitation of Liability

To the maximum extent permitted by applicable law, GetBotl's liability to you for any claim arising out of or related to these Terms or the Services is limited as follows:

  • Order Disputes: GetBotl's maximum liability for any claim related to a specific order is limited to the total amount paid by you for that order, including the delivery fee.
  • Third-Party Acts: GetBotl is not liable for the acts, omissions, errors, or negligence of licensed retail partners or couriers that arise beyond GetBotl's role as a technology platform facilitating the transaction.
  • Indirect Damages: GetBotl is not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, loss of data, or personal injury, arising from your use of the Services.
  • Service Availability: GetBotl does not guarantee uninterrupted availability of the Services and is not liable for losses resulting from service outages, technical errors, or interruptions outside our reasonable control.

Some jurisdictions do not allow the exclusion or limitation of certain damages. If you reside in such a jurisdiction, some or all of the above limitations may not apply to you.

Indemnification: You agree to indemnify, defend, and hold harmless GetBotl Inc., its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the Services, or your violation of any applicable law.

Section 10

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to conflict-of-law principles.

Dispute Resolution

  • Informal Resolution First: Before initiating any formal dispute process, you agree to contact GetBotl at legal@getbotl.com and attempt to resolve the dispute informally. We will make good-faith efforts to resolve your concern within 30 days.
  • Arbitration: If informal resolution fails, you agree that any dispute, claim, or controversy arising from or relating to these Terms or the Services shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court.
  • Opt-Out Right: You may opt out of arbitration within 30 days of your account creation by sending written notice to legal@getbotl.com. If you opt out, disputes shall be brought exclusively in the state or federal courts located in New York County, New York.
  • Class Action Waiver: You agree that any dispute will be resolved on an individual basis and not as part of a class, consolidated, or representative action, to the extent permitted by applicable law.

Any dispute not subject to arbitration shall be brought exclusively in the state and federal courts of New York County, New York, and you consent to personal jurisdiction and venue in those courts.
